Welcome to Thistle Medical Aesthetics (“Thistle,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to land use of our website, online store, and related services (collectively, the “Site”). By using the Site, you agree to these Terms.
If you do not agree, do not use the Site.
1) Eligibility and Use of the Site
You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order through our online store. You agree not to use the Site for any unlawful purpose or in a way that could harm Thistle or any other user.
2) No Medical Advice; Informational Purposes Only
Content on this Site is provided for general informational and educational purposes only and is not medical advice. Use of the Site does not create a provider-patient relationship. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition or treatment.
3) Appointments, Consultations, and In-Office Services
Online bookings and inquiries are subject to availability and confirmation by Thistle. Treatment recommendations are individualized and require an in-person consultation. Results vary by individual.
Deposits, cancellation policies, late arrivals, and no-show policies for appointments may be communicated at the time of booking and under our Policy Page. By booking with us, you agree to the terms outlined in our cancellation policy. Thistle reserves the right to refuse or discontinue services where clinically appropriate or as permitted by law.
4) Online Store Orders
When you place an order, you agree that:
You are authorized to use the payment method provided.
You will provide accurate billing and shipping information.
Orders are subject to acceptance and product availability.
We may refuse, cancel, or limit quantities at our discretion, including in cases of suspected fraud, unauthorized activity, or inventory issues.
5) Pricing, Promotions, and Product Availability
Prices and promotions are subject to change without notice. Promotional offers cannot be combined unless explicitly stated. Product availability is not guaranteed and may change.
If a product becomes unavailable after you place an order, we may cancel and refund the affected item(s) or offer an alternative.
6) Shipping and Delivery
We ship to the addresses you provide. Shipping timelines are estimates and may be affected by carrier delays or events outside our control. Title and risk of loss pass to you upon delivery to the carrier, to the extent permitted by law.
You are responsible for providing a correct shipping address. If an order is returned due to an incorrect address, additional shipping charges may apply.
7) Returns, Refunds, and Exchanges
REFUND POLICY
We do not offer refunds on services rendered. Products may be refunded within 14 days and must not be opened or used. In the rare chance that you have an allergic reaction to a product, it may be exchanged for alternative products. Please speak with one of our providers so that we can assist in resolving the issue.
PACKAGE POLICY
For optimal results, all prepaid treatment packages must be used within 1 year of purchase. No refunds on packages purchased unless medically ineligible. In this case, completed treatments will be calculated as a single treatment and any remaining credit may be used on other services within 1 year of purchase.
GIFT CERTIFICATE POLICY
All gift certificates purchased with us, online or in person, must be used within 1 year of purchase unless otherwise stated on the certificate. Patient must present gift card at checkout. We do not offer refunds on Thistle Gift Certificates.
8) Membership Renewal, Cancellation, and Modifications
Memberships automatically renew thirty (30) days prior to the first month of the next billing period. To avoid renewal charges, Members must submit a cancellation request at least thirty (30) days before the next scheduled billing date. Any payments processed due to late or untimely cancellation requests are non-refundable.
After completion of the required minimum Membership term of six (6) or twelve (12) months, Memberships will automatically renew for subsequent billing periods at the same monthly rate. Once the minimum term has been fulfilled, Members may cancel their Membership at any time in accordance with the cancellation procedures outlined below.
Members may cancel their Membership independently at any time through their online client portal. If a Member prefers that Thistle Medical Aesthetics process the cancellation on their behalf, written notice must be provided at least thirty (30) days prior to the next billing date. Written cancellation requests must be submitted to info@thistlemedicalaesthetics.com and are considered received only upon confirmation by the Thistle Medical Aesthetics team. If written notice is not submitted within the required thirty (30) day window and the next billing cycle is processed, the resulting charge is non-refundable.
Thistle Medical Aesthetics reserves the right to modify, amend, or update its Membership program, including pricing, benefits, terms, and conditions, at any time. Any changes will apply prospectively and, where required by law, Members will be notified in advance.
Thistle Medical Aesthetics also reserves the right to suspend or discontinue the Membership program at any time, with or without prior notice.
9) Product Use and Results
Our products are intended for cosmetic/skin health support and may not be appropriate for everyone. Follow product directions and discontinue use if irritation occurs. If you are pregnant, nursing, have allergies, or have a medical condition, consult a qualified healthcare provider before use.
Individual results vary. We do not guarantee outcomes.
10) Intellectual Property
All Site content (text, images, graphics, logos, videos, design, and layout) is owned by or licensed to Thistle and protected by intellectual property laws. You may not reproduce, distribute, modify, or exploit Site content without our prior written permission.
11) User Content and Reviews
If you submit reviews, comments, photos, or other content (“User Content”), you grant Thistle a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that User Content for business purposes, including marketing, unless prohibited by law.
You agree not to submit content that is unlawful, misleading, defamatory, infringing, or violates another person’s rights.
12) Prohibited Conduct
You agree not to:
Attempt to gain unauthorized access to the Site or systems,
Interfere with Site security or functionality,
Upload malware or harmful code,
Use the Site to violate any law or regulation.
13) Third-Party Links and Services
The Site may include links to third-party websites or services (e.g., payment processors, shipping carriers). Thistle is not responsible for third-party content, privacy practices, or services.
14) Disclaimer of Warranties
THE SITE AND ALL CONTENT AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THISTLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS.
IN NO EVENT SHALL THISTLE’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO THISTLE FOR THE APPLICABLE PURCHASE OR, IF NO PURCHASE WAS MADE, ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER, UNLESS OTHERWISE REQUIRED BY LAW.
16) Indemnification
You agree to defend, indemnify, and hold harmless Thistle and its owners, employees, contractors, and affiliates from claims, damages, liabilities, and expenses arising from your use of the Site, your violation of these Terms, or your infringement of any rights of a third party.
17) Privacy
Your use of the Site is also subject to our Privacy Policy. Please review it to understand how we collect and use information.
18) Electronic Communications and Text Messages (If Applicable)
By providing your email or phone number, you consent to receive communications related to your orders and services. If you opt into marketing texts/emails, you may opt out at any time using the instructions provided. Message and data rates may apply.
19) Changes to These Terms
We may update these Terms from time to time. The “Effective Date” above indicates when these Terms were last updated. Your continued use of the Site after changes are posted constitutes acceptance.
20) Governing Law and Venue (Virginia)
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any dispute arising from these Terms shall be brought in the state or federal courts located in Stafford, Virginia, and you consent to the jurisdiction of those courts.
